NovaWiFi Terms & Conditions

1. Scope
These Terms & Conditions ("Terms") apply to reseller and ISP users ("Resellers") who create an account and use NovaWiFi services, tools, and software ("Services"). By creating an account or using the Services, you agree to these Terms.
2. Account & Eligibility
You must provide accurate and complete information. You are responsible for all activity under your account and for maintaining the confidentiality of your credentials. You may not share your account or allow unauthorized use.
3. Fees, Billing & No-Refund Policy
Service fees are billed as displayed in the platform. Once payment is made and the account is active, all fees are non-refundable, including system fees, whether or not you use the Services. You remain responsible for all charges incurred under your account.
4. Acceptable Use
You agree not to use the Services for unlawful activities, abuse, fraud, spam, or to interfere with the network, platform, or other customers. You must comply with applicable laws, regulations, and telecom requirements.
5. Service Availability
Services are provided on an "as-is" and "as-available" basis. We may perform maintenance, updates, or changes that could affect availability. We do not guarantee uninterrupted uptime.
6. Liability Limitations
To the maximum extent permitted by law, NovaWiFi is not liable for indirect, incidental, special, or consequential damages, including loss of revenue, data, or business. Our total liability for any claim is limited to the fees paid by you in the three (3) months preceding the event giving rise to the claim.
7. Data & Privacy
You are responsible for the data you upload and process through the Services. We may process operational data to provide and improve Services. You must ensure you have lawful grounds to collect and process end-user data.
8. Termination
We may suspend or terminate your account if you violate these Terms or applicable law. You may stop using the Services at any time, but fees already paid remain non-refundable.
9. Changes to Terms
We may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of Kenya. Any disputes will be resolved in the competent courts of Kenya.
